2. Acceptance of Terms
By accessing or using miron-atelier.com, creating an account, or completing a purchase, you confirm that you: (i) are at least 18 years of age; (ii) have the legal capacity to enter into a binding agreement; and (iii) agree to these Terms of Service in full. If you do not agree, you must not use this website or place any order.
These Terms are incorporated by reference into, and should be read alongside, our Return & Refund Policy, Shipping Policy, 2-Year Motor Warranty, and Privacy Policy, all of which form part of the agreement between you and Miron Atelier.
3. Products & Pricing
All products listed on miron-atelier.com are subject to availability. We reserve the right to discontinue any product at any time without notice. Product images are for illustrative purposes only; actual products may vary slightly from those depicted.
All prices are displayed in US Dollars (USD) and are exclusive of any applicable import duties, customs fees, or local taxes, which are the sole responsibility of the buyer. We make every effort to ensure pricing accuracy. In the event of a pricing error, we reserve the right to cancel any order placed at the incorrect price and will notify you promptly by email.
4. Orders & Payment
When you place an order, you make an offer to purchase. We reserve the right to accept or decline any order at our sole discretion. An order confirmation email does not constitute acceptance; your order is accepted when we dispatch the product and send you a shipping confirmation.
We may cancel or refuse an order where: (i) a product is out of stock; (ii) we suspect fraudulent or unauthorized activity; (iii) a pricing error has occurred; or (iv) we are unable to ship to your location. In such cases, any payment received will be refunded in full.
We accept Visa, Mastercard, American Express, PayPal, Apple Pay, Google Pay, and Shop Pay. All transactions are processed through Shopify’s PCI DSS Level 1 certified payment infrastructure. Miron Atelier does not store your payment card information.
5. Shipping
All shipping terms, delivery timeframes, customs responsibilities, and related matters are governed by our Shipping Policy, which is incorporated into these Terms by reference.

7. Warranty
Our 2-Year Limited Motor Warranty covers defects in the motor and winding mechanism of motorized products purchased directly from miron-atelier.com. All warranty claims are subject to the eligibility conditions and procedures set out in the Warranty Policy, which is incorporated into these Terms by reference.

- We make no warranty that this website will be available without interruption or free of errors
Some jurisdictions do not permit the exclusion or limitation of certain damages, so the above may not apply to you in full.
13. Dispute Resolution
13.1 Informal Resolution
Before initiating any formal legal proceeding, you agree to contact us at support@miron-atelier.com to describe the nature of your dispute and allow us 30 days to attempt an informal resolution.
13.2 Binding Arbitration (US Customers)
If informal resolution fails, any dispute arising out of or relating to these Terms or your purchase from miron-atelier.com shall be resolved by binding individual arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules, rather than in court. Arbitration shall take place in Bernalillo County, New Mexico, or by videoconference.
Class Action Waiver: All claims must be brought on an individual basis only. The arbitrator may not consolidate more than one person’s claims and may not preside over any class or representative proceeding.
Small Claims Exception: Either party may bring an individual claim in small claims court for disputes within that court’s jurisdiction.
Opt-Out: You may opt out of this arbitration agreement within 30 days of your first purchase by emailing support@miron-atelier.com with the subject line “Arbitration Opt-Out.” Opting out will not affect your right to make purchases.
14. Governing Law
These Terms and any dispute arising hereunder are governed by the laws of the State of New Mexico and applicable federal law of the United States, without regard to conflict of law principles.
Nothing in these Terms limits any rights you may have under the mandatory consumer protection laws of your country of residence that cannot be excluded by agreement.
15. Severability
If any provision of these Terms is found to be invalid or unenforceable, that provision shall be modified to the minimum extent necessary to make it enforceable, or severed if modification is not possible, without affecting the remaining provisions.
